공직선거법 제162조(사전투표참관)

① 사전투표관리관은 사전투표참관인으로 하여금 사전투표 상황을 참관하게 하고, 제158조제6항제1호에 따라 관할 우체국장에게 투표지를 인계하기까지 일련의 과정에 동행하게 하여야 한다. <개정 2014.1.17, 2021.3.26>

② 정당ㆍ후보자ㆍ선거사무장 또는 선거연락소장은 후보자마다 사전투표소별로 2명의 사전투표참관인을 선정하여 선거일 전 7일까지 구ㆍ시ㆍ군선거관리위원회에 서면으로 신고하여야 하고, 필요한 경우 언제든지 신고한 후 교체할 수 있으며 사전투표기간 중에는 사전투표소에서 교체신고를 할 수 있다. <개정 2014.1.17>

③ 사전투표참관인은 사전투표소마다 8명으로 하되, 제2항에 따라 선정ㆍ신고한 인원수가 8명을 넘는 때에는 관할구ㆍ시ㆍ군선거관리위원회가 추첨에 의하여 지정한 사람을 사전투표참관인으로 한다. 이 경우 후보자수가 8명을 넘는 때에는 후보자별로 1명씩 우선 선정한 후 추첨에 의하여 8명을 지정하고, 후보자수가 8명에 미달하되 후보자가 선정ㆍ신고한 인원수가 8명을 넘는 때에는 후보자별로 1명씩 선정한 사람을 우선 지정한 후 나머지 인원은 추첨에 의하여 지정한다. <신설 2025.1.7>

④제2항에 따른 사전투표참관인의 선정이 없거나 한 후보자가 선정한 사전투표참관인밖에 없는 때에는 관할구ㆍ시ㆍ군선거관리위원회가 선거권자중에서 본인의 승낙을 얻어 4인에 달할 때까지 선정한 자를 사전투표참관인으로 한다. <개정 2005.8.4, 2014.1.17, 2025.1.7>

⑤사전투표참관에 관하여는 제161조제6항부터 제12항까지의 규정을 준용한다. 이 경우 "읍ㆍ면ㆍ동선거관리위원회"는 "관할구ㆍ시ㆍ군선거관리위원회"로, "투표관리관"은 "사전투표관리관"으로, "투표참관인"은 "사전투표참관인"으로 본다. <개정 2000.2.16, 2005.8.4, 2010.1.25, 2014.1.17, 2015.8.13, 2025.1.7>

⑥사전투표참관인신고서의 서식, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <개정 2014.1.17, 2025.1.7>
