공직선거법 제265조(선거사무장등의 선거범죄로 인한 당선무효)

선거사무장ㆍ선거사무소의 회계책임자(선거사무소의 회계책임자로 선임ㆍ신고되지 아니한 자로서 후보자와 통모하여 당해 후보자의 선거비용으로 지출한 금액이 선거비용제한액의 3분의 1 이상에 해당되는 자를 포함한다) 또는 후보자(후보자가 되려는 사람을 포함한다)의 직계존비속 및 배우자가 해당 선거에 있어서 제230조부터 제234조까지, 제257조제1항 중 기부행위를 한 죄 또는 「정치자금법」 제45조제1항의 정치자금 부정수수죄를 범함으로 인하여 징역형 또는 300만원 이상의 벌금형의 선고를 받은 때(선거사무장, 선거사무소의 회계책임자에 대하여는 선임ㆍ신고되기 전의 행위로 인한 경우를 포함한다)에는 그 선거구 후보자(대통령후보자, 비례대표국회의원후보자 및 비례대표지방의회의원후보자를 제외한다)의 당선은 무효로 한다. 다만, 다른 사람의 유도 또는 도발에 의하여 당해 후보자의 당선을 무효로 되게 하기 위하여 죄를 범한 때에는 그러하지 아니하다. <개정 1995.5.10, 2000.2.16, 2004.3.12, 2005.8.4, 2010.1.25>
