공직선거법 제37조(명부작성)

① 선거를 실시하는 때마다 구(자치구가 아닌 구를 포함한다)ㆍ시(구가 설치되지 아니한 시를 말한다)ㆍ군(이하 "구ㆍ시ㆍ군"이라 한다)의 장은 대통령선거에서는 선거일 전 28일, 국회의원선거와 지방자치단체의 의회의원 및 장의 선거에서는 선거일 전 22일(이하 "선거인명부작성기준일"이라 한다) 현재 제15조에 따라 그 관할 구역에 주민등록이 되어 있는 선거권자(지방자치단체의 의회의원 및 장의 선거의 경우 제15조제2항제3호에 따른 외국인을 포함하고, 제218조의13에 따라 확정된 재외선거인명부 또는 다른 구ㆍ시ㆍ군의 국외부재자신고인명부에 올라 있는 사람은 제외한다)를 투표구별로 조사하여 선거인명부작성기준일부터 5일 이내(이하 "선거인명부작성기간"이라 한다)에 선거인명부를 작성하여야 한다. 이 경우 제218조의13에 따라 확정된 국외부재자신고인명부에 올라 있는 사람은 선거인명부의 비고란에 그 사실을 표시하여야 한다. <개정 2009.2.12, 2011.7.28, 2012.2.29, 2014.1.17, 2015.8.13>

②선거인명부에는 선거권자의 성명ㆍ주소ㆍ성별 및 생년월일 기타 필요한 사항을 기재하여야 한다.

③누구든지 같은 선거에 있어 2 이상의 선거인명부에 오를 수 없다.

④구ㆍ시ㆍ군의 장은 선거인명부를 작성한 때에는 즉시 그 전산자료 복사본을 관할구ㆍ시ㆍ군선거관리위원회에 송부하여야 한다. <개정 2009.2.12, 2018.4.6>

⑤하나의 투표구의 선거권자의 수가 1천인을 넘는 때에는 그 선거인명부를 선거인수가 서로 엇비슷하게 분철할 수 있다.

(5) If이^f프 the^ð더 number넘버 of어^v브 persons퍼슨즈 with위^ð드 the^ð더 right^r라잇 to투 vote^v보우트 in인 one원 voting^v보우팅 district디스트^r릭트 exceeds익시즈 1,000, the^ð더 register^r레지스터 of어^v브 electors일렉터즈 may메이 be비 divided디^v바이디드 into인투 volumes^v발륨즈 with위^ð드 roughly^r러^f플리 equal이퀄 numbers넘버즈 of어^v브 electors.일렉터즈

⑥제1항의 규정에 의한 선거인명부의 작성은 전산조직에 의할 수 있다. <개정 2005.8.4>

⑦ 행정안전부장관은 제1항에 따른 선거인명부의 작성을 지원하기 위하여 「주민등록법」 제7조의2제1항에 따른 주민등록번호, 「출입국관리법」 제31조제5항에 따른 외국인등록번호 및 「재외동포의 출입국과 법적 지위에 관한 법률」 제7조제1항에 따른 국내거소신고번호를 처리할 수 있고, 처리한 사항을 구ㆍ시ㆍ군의 장 등에게 제공할 수 있다. 이 경우 행정안전부장관은 관계 행정기관의 장 또는 그 밖의 공공기관의 장에게 필요한 자료를 요청할 수 있고, 요청을 받은 자는 특별한 사유가 없으면 이에 따라야 한다. <신설 2022.1.21>

⑧선거인명부의 서식 기타 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <개정 2022.1.21>
