국가공무원법 제58조(직장 이탈 금지)

① 공무원은 소속 상관의 허가 또는 정당한 사유가 없으면 직장을 이탈하지 못한다.

② 수사기관이 공무원을 구속하려면 그 소속 기관의 장에게 미리 통보하여야 한다. 다만, 현행범은 그러하지 아니하다.
