국가공무원법 제73조의4(강임)

① 임용권자는 직제 또는 정원의 변경이나 예산의 감소 등으로 직위가 폐직되거나 하위의 직위로 변경되어 과원이 된 경우 또는 본인이 동의한 경우에는 소속 공무원을 강임할 수 있다. <개정 2010.3.22>

② 제1항에 따라 강임된 공무원은 상위 직급 또는 고위공무원단 직위에 결원이 생기면 제40조ㆍ제40조의2ㆍ제40조의4 및 제41조에도 불구하고 우선 임용된다. 다만, 본인이 동의하여 강임된 공무원은 본인의 경력과 해당 기관의 인력 사정 등을 고려하여 우선 임용될 수 있다.
