Enforcement Decree of the Act on Honorable Treatment and Support for Persons of Distinguished Service to the State, Article 8 (Application for Registration)

① 법 제6조제1항에 따라 국가유공자, 그 유족 또는 가족이 되려는 경우에는 그 중 다음 각 호의 순위에 따른 선순위자(선순위자인 유족이 부득이한 사유로 등록신청을 할 수 없는 경우에는 그 밖에 법 제5조제1항 각 호에 따른 유족을 말한다)가 등록신청서에 국가보훈부령으로 정하는 서류를 첨부하여 국가보훈부장관에게 신청하여야 한다. 다만, 법 제6조제1항 단서에 따라 국가보훈부 소속 공무원이 국가유공자, 그 유족 또는 가족이 되려는 사람의 등록을 신청하려는 경우에는 등록신청서에 다음 각 호의 순위에 따른 선순위자(선순위자인 유족이 부득이한 사유로 기명날인 또는 서명할 수 없는 경우에는 그 밖에 법 제5조제1항 각 호에 따른 유족을 말한다)의 기명날인 또는 서명을 받은 동의서(등록신청서에 동의 사실이 포함된 경우에는 해당 등록신청서를 말한다)와 국가보훈부령으로 정하는 서류를 첨부하여 국가보훈부장관에게 제출하여야 한다. <개정 2012.6.27, 2013.6.28, 2018.12.31, 2023.5.23>

1. 국가유공자 또는 법 제13조에 따른 선순위자인 유족

2. 제1호에 해당되지 아니하는 유족은 법 제5조제1항 각 호의 순위에 따른 선순위자로 하되, 같은 순위인 경우에는 법 제13조에 따른 순위에 따른다.

② 법 제6조제1항제3호에서 "대통령령으로 정하는 사유"란 고령, 부상, 질병, 신체적ㆍ정신적 장애 또는 그 밖의 부득이한 사유를 말한다. <신설 2013.6.28>
