National Health Promotion Act, Article 9-5 (Smoking Cessation Instructors)

① 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 금연을 위한 조치를 위하여 대통령령으로 정하는 자격이 있는 사람 중에서 금연지도원을 위촉할 수 있다.

② 금연지도원의 직무는 다음 각 호와 같다.

1. 금연구역의 시설기준 이행 상태 점검

1. Checking체킹 compliance컴플라이언스 with위^ð드 facility^f퍼실리티 standards스탠더즈 for^f포 non-smoking난-스모우킹 areas;에^r리어즈

2. 금연구역에서의 흡연행위 감시 및 계도

2. Monitoring마너터^r링 smoking스모우킹 in인 non-smoking난-스모우킹 areas에^r리어즈 and앤드 giving기^v빙 guidance;가이든스

3. 금연을 위한 조치를 위반한 경우 관할 행정관청에 신고하거나 그에 관한 자료 제공

3. Reporting^r리포팅 violations^v바이얼레이션즈 of어^v브 measures메저즈 for^f포 smoking스모우킹 cessation세세이션 to투 the^ð더 competent캄퍼틴트 administrative어드미너스트^r레이티^v브 agency에이전시 or오 providing프^r러^v바이딩 materials머티^r리얼즈 on안 them;^ð뎀

4. 그 밖에 금연 환경 조성에 관한 사항으로서 대통령령으로 정하는 사항

③ 금연지도원은 제2항의 직무를 단독으로 수행하려면 미리 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장의 승인을 받아야 하며, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 승인서를 교부하여야 한다.

④ 금연지도원이 제2항에 따른 직무를 단독으로 수행하는 때에는 승인서와 신분을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.

⑤ 제1항에 따라 금연지도원을 위촉한 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 금연지도원이 그 직무를 수행하기 전에 직무 수행에 필요한 교육을 실시하여야 한다.

(5) A어 Mayor/Do메이어 Governor거^v버너 or오 the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 who후 has해즈 commissioned커미션드 smoking스모우킹 cessation세세이션 instructors인스트^r럭터즈 under언더 paragraph패^r러그^r래^f프 (1) shall섈 provide프^r러^v바이드 them^ð뎀 with위^ð드 the^ð더 training트^r레이닝 necessary네서세^r리 to투 perform퍼^f폼 their^ð데어 duties두티즈 before비^f포 they^ð데이 begin비긴 performing퍼^f포밍 those^ð도우즈 duties.두티즈

⑥ 금연지도원은 제2항에 따른 직무를 수행하는 경우 그 권한을 남용하여서는 아니 된다.

(6) A어 smoking스모우킹 cessation세세이션 instructor인스트^r럭터 shall섈 not낫 abuse어뷰스 his히즈 or오 her허 authority어^θ쏘^r러티 when웬 performing퍼^f포밍 the^ð더 duties두티즈 under언더 paragraph패^r러그^r래^f프 (2).

⑦ 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 금연지도원이 다음 각 호의 어느 하나에 해당하면 그 금연지도원을 해촉하여야 한다.

(7) A어 Mayor/Do메이어 Governor거^v버너 or오 the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 shall섈 dismiss디스미스 a어 smoking스모우킹 cessation세세이션 instructor인스트^r럭터 who후 falls^f폴즈 under언더 any에니 of어^v브 the^ð더 following^f팔로잉 subparagraphs:서브패^r러그^r래^f프스

1. 제1항에 따라 대통령령으로 정한 자격을 상실한 경우

2. 제2항에 따른 직무와 관련하여 부정한 행위를 하거나 그 권한을 남용한 경우
