Act on the Linkage between the National Pension and Occupational Pensions, Article 18 (Adjustment of Duplicate Benefits)
① 같은 연계급여 수급권자에게 이 법에 따른 둘 이상의 연계급여 수급권이 생기면 그 수급권자의 선택에 따라 다음 각 호의 구분에 따라 조정한다. <개정 2016.5.29>
(1) Where a person entitled to the same linked benefits comes to hold the right to two or more linked benefits under this Act, they shall be adjusted at the election of the person entitled, as classified below:
1. 연계노령연금 수급권 및 연계노령유족연금 수급권이 생긴 경우
1. Where the right to a linked old-age pension and the right to a linked old-age survivors' pension arise:
가. 연계노령연금 수급권을 선택한 경우에는 연계노령연금액은 지급하고 연계노령유족연금액은 그 연금액의 100분의 30을 지급한다.
(a) Where the right to a linked old-age pension is elected, the linked old-age pension amount is paid and 30/100 of the linked old-age survivors' pension amount is paid; and
나. 연계노령유족연금 수급권을 선택한 경우에는 연계노령유족연금액만을 지급한다.
(b) Where the right to a linked old-age survivors' pension is elected, only the linked old-age survivors' pension amount is paid;
2. 연계노령유족연금 수급권이 둘 이상 생긴 경우에는 선택한 연계노령유족연금액과 선택하지 아니한 연계노령유족연금액의 100분의 30을 지급한다.
2. Where two or more rights to linked old-age survivors' pensions arise, the elected linked old-age survivors' pension amount and 30/100 of the non-elected linked old-age survivors' pension amount are paid; and
3. 연계퇴직연금 수급권 및 연계퇴직유족연금 수급권이 생긴 경우에는 연계퇴직연금액은 지급하고 연계퇴직유족연금액은 그 연금액의 2분의 1을 지급한다.
3. Where the right to a linked retirement pension and the right to a linked retirement survivors' pension arise, the linked retirement pension amount is paid and one-half of the linked retirement survivors' pension amount is paid.
② 같은 연계급여 수급권자에게 이 법에 따른 연계급여 수급권과 각 연금법에 따른 급여 수급권이 함께 생기면 그 수급권자의 선택에 따라 다음 각 호의 구분에 따라 조정한다. 다만, 연계급여 수급권과 다음 각 호에 규정된 급여 수급권 외의 급여 수급권이 함께 생긴 경우에는 해당 급여 수급권의 지급은 각 연금법에 따른다. <개정 2016.5.29>
(2) Where a person entitled to the same linked benefits comes to hold both a right to linked benefits under this Act and a right to benefits under each pension Act, they shall be adjusted at the election of the person entitled, as classified below. However, where a right to benefits other than those prescribed in the following subparagraphs arises together with a right to linked benefits, the payment of such benefits is governed by each pension Act:
1. 연계노령연금 수급권 및 「국민연금법」에 따른 유족연금 수급권이 생긴 경우
1. Where the right to a linked old-age pension and the right to a survivors' pension under the National Pension Act arise:
가. 연계노령연금 수급권을 선택한 경우에는 연계노령연금액은 지급하고 유족연금액은 그 연금액의 100분의 30을 지급한다.
(a) Where the right to a linked old-age pension is elected, the linked old-age pension amount is paid and 30/100 of the survivors' pension amount is paid; and
나. 「국민연금법」에 따른 유족연금 수급권을 선택한 경우에는 유족연금액만을 지급한다.
(b) Where the right to a survivors' pension under the National Pension Act is elected, only the survivors' pension amount is paid;
2. 연계퇴직연금 수급권 및 직역연금법에 따른 유족연금 수급권이 생긴 경우
2. Where the right to a linked retirement pension and the right to a survivors' pension under an occupational pension Act arise:
가. 연계퇴직연금 수급권을 선택한 경우에는 연계퇴직연금액은 지급하고 직역연금법에 따른 유족연금액은 그 연금액의 2분의 1을 지급한다.
(a) Where the right to a linked retirement pension is elected, the linked retirement pension amount is paid and one-half of the survivors' pension amount under the occupational pension Act is paid; and
나. 직역연금법에 따른 유족연금 수급권을 선택한 경우에는 유족연금액만을 지급한다.
(b) Where the right to a survivors' pension under an occupational pension Act is elected, only the survivors' pension amount is paid;
3. 연계노령유족연금 수급권 및 「국민연금법」에 따른 유족연금 수급권이 생긴 경우
3. Where the right to a linked old-age survivors' pension and the right to a survivors' pension under the National Pension Act arise:
가. 연계노령유족연금 수급권을 선택한 경우에는 연계노령유족연금액은 지급하고 유족연금액은 그 연금액의 100분의 30을 지급한다.
(a) Where the right to a linked old-age survivors' pension is elected, the linked old-age survivors' pension amount is paid and 30/100 of the survivors' pension amount is paid; and
나. 「국민연금법」에 따른 유족연금 수급권을 선택한 경우에는 유족연금액은 지급하고 연계노령유족연금액은 그 연금액의 100분의 30을 지급한다.
(b) Where the right to a survivors' pension under the National Pension Act is elected, the survivors' pension amount is paid and 30/100 of the linked old-age survivors' pension amount is paid;
4. 연계노령유족연금 수급권 및「국민연금법」에 따른 노령연금 수급권이 생긴 경우
4. Where the right to a linked old-age survivors' pension and the right to an old-age pension under the National Pension Act arise:
가. 연계노령유족연금 수급권을 선택한 경우에는 연계노령유족연금액만을 지급한다.
(a) Where the right to a linked old-age survivors' pension is elected, only the linked old-age survivors' pension amount is paid; and
나. 「국민연금법」에 따른 노령연금 수급권을 선택한 경우에는 노령연금액은 지급하고 연계노령유족연금액은 그 연금액의 100분의 30을 지급한다.
(b) Where the right to an old-age pension under the National Pension Act is elected, the old-age pension amount is paid and 30/100 of the linked old-age survivors' pension amount is paid;
5. 연계노령연금 수급권 및 「국민연금법」에 따른 장애연금 수급권이 생긴 경우에는 선택한 해당 연금액만을 지급한다.
5. Where the right to a linked old-age pension and the right to a disability pension under the National Pension Act arise, only the elected pension amount is paid;
6. 연계노령유족연금 수급권 및 「국민연금법」에 따른 장애연금 수급권이 생긴 경우
6. Where the right to a linked old-age survivors' pension and the right to a disability pension under the National Pension Act arise:
가. 연계노령유족연금 수급권을 선택한 경우에는 연계노령유족연금액만을 지급한다.
(a) Where the right to a linked old-age survivors' pension is elected, only the linked old-age survivors' pension amount is paid; and
나. 「국민연금법」에 따른 장애연금 수급권을 선택한 경우에는 장애연금액은 지급하고 연계노령유족연금액은 그 연금액의 100분의 30을 지급한다.
(b) Where the right to a disability pension under the National Pension Act is elected, the disability pension amount is paid and 30/100 of the linked old-age survivors' pension amount is paid; and
7. 연계노령유족연금 수급권 및 「국민연금법」에 따른 반환일시금이 생긴 경우
7. Where the right to a linked old-age survivors' pension and a refund lump sum under the National Pension Act arise:
가. 연계노령유족연금 수급권을 선택한 경우에는 연계노령유족연금액은 지급하고 반환일시금은 「국민연금법」 제80조제2항에 상당하는 금액을 지급한다.
(a) Where the right to a linked old-age survivors' pension is elected, the linked old-age survivors' pension amount is paid and an amount equivalent to that under Article 80 (2) of the National Pension Act is paid as the refund lump sum; and
나. 「국민연금법」에 따른 반환일시금을 선택한 경우에는 반환일시금만을 지급한다.
(b) Where the refund lump sum under the National Pension Act is elected, only the refund lump sum is paid.
③ 같은 연계급여 수급권자에게 연계퇴직유족연금 수급권 및 각 직역연금법에 따른 퇴직연금ㆍ퇴역연금 수급권이 생긴 경우에는 각 직역연금법에 따른 퇴직연금ㆍ퇴역연금은 지급하고 연계퇴직유족연금은 그 연금액의 2분의 1을 지급한다.
(3) Where a person entitled to the same linked benefits comes to hold the right to a linked retirement survivors' pension and the right to a retirement pension or retired-service pension under each occupational pension Act, the retirement pension or retired-service pension under each occupational pension Act is paid and one-half of the linked retirement survivors' pension is paid.
④ 연계급여 수급권자가 제2항제2호에 따라 연계퇴직연금 또는 직역연금법에 따른 유족연금을 선택한 경우에는 연계급여 또는 급여가 지급된 후에는 그 선택을 바꿀 수 없다.
(4) Where a person entitled to linked benefits elects a linked retirement pension or a survivors' pension under an occupational pension Act pursuant to paragraph (2) 2, the election cannot be changed after the linked benefits or benefits have been paid.
⑤ 제1항부터 제4항까지에서 규정한 사항 외에 연계급여 수급권자에게 이 법 또는 연금법에 따라 둘 이상의 급여 수급권이 생기는 경우 중복급여의 조정에 관하여는 각 연금법을 준용한다.
(5) Except as prescribed in paragraphs (1) through (4), each pension Act applies mutatis mutandis to the adjustment of duplicate benefits where a person entitled to linked benefits comes to hold the right to two or more benefits under this Act or pension Acts.
