국민연금법 제55조(미지급 급여)

① 수급권자가 사망한 경우 그 수급권자에게 지급하여야 할 급여 중 아직 지급되지 아니한 것이 있으면 그 배우자ㆍ자녀ㆍ부모ㆍ손자녀ㆍ조부모 또는 형제자매의 청구에 따라 그 미지급 급여를 지급한다. 다만, 가출ㆍ실종 등 대통령령으로 정하는 경우에 해당하는 사람에게는 지급하지 아니하며, 형제자매의 경우에는 대통령령으로 정하는 바에 따라 수급권자의 사망 당시(「민법」 제27조제1항에 따른 실종선고를 받은 경우에는 실종기간의 개시 당시를, 같은 조 제2항에 따른 실종선고를 받은 경우에는 사망의 원인이 된 위난 발생 당시를 말한다) 수급권자에 의하여 생계를 유지하고 있던 사람에게만 지급한다. <개정 2011.12.31, 2016.5.29>

② 제1항에 따른 급여를 받을 순위는 배우자, 자녀, 부모, 손자녀, 조부모, 형제자매의 순으로 한다. 이 경우 순위가 같은 사람이 2명 이상이면 똑같이 나누어 지급하되, 지급 방법은 대통령령으로 정한다.

③ 제1항에 따른 미지급 급여는 수급권자가 사망한 날부터 5년 이내에 청구하여야 한다. <신설 2011.12.31>
