군사법원법 제215조(감정에 필요한 처분)

① 감정인은 감정에 필요하면 군사법원의 허가를 받아 다른 사람의 주거나 관리자가 있는 가옥, 건조물, 항공기, 선박 또는 차량에 들어갈 수 있고, 신체 검사, 사체 해부, 무덤 발굴 또는 물건 파괴를 할 수 있다.

② 제1항의 허가를 할 때에는 피고인의 성명, 죄명, 들어갈 장소, 검사할 신체, 해부할 사체, 발굴할 무덤, 파괴할 물건, 감정인의 성명 및 유효기간을 적은 허가장을 발급하여야 한다.

③ 감정인은 제1항의 처분을 받는 사람에게 허가장을 보여주어야 한다.

④ 제2항과 제3항은 감정인이 공판정에서 하는 제1항의 처분에는 적용하지 아니한다.
