군사법원법 제313조(공판기일의 변경)

① 재판장은 직권으로 또는 군검사, 피고인이나 변호인의 신청을 받아 공판기일을 변경할 수 있다. <개정 2016.1.6>

② 공판기일의 변경은 직권으로 하는 경우에는 군검사, 피고인 또는 변호인의 의견을 물어야 하고, 신청에 따라 하는 경우에는 상대방이나 변호인의 의견을 물어야 한다. 다만, 긴급히 변경하여야 하는 경우에는 그러하지 아니하다. <개정 2016.1.6>

③ 공판기일 변경신청을 기각하는 명령은 송달하지 아니한다.
