군인연금법 제28조(퇴직일시금)

① 군인이 20년 미만 복무하고 퇴직한 경우에는 퇴직일시금을 지급한다.

② 복무기간이 5년 이상 20년 미만인 사람의 퇴직일시금의 금액은 제21조제3항에 따라 산정되는 금액으로 한다.

④ 제2항 또는 제3항에 따라 산정한 금액이 이미 낸 기여금에 「민법」 제379조에 따른 이자를 가산한 금액보다 적을 경우에는 제2항 또는 제3항에도 불구하고 제2항 또는 제3항에 따라 산정한 금액을 갈음하여 기여금에 「민법」 제379조에 따른 이자를 가산한 금액을 퇴직일시금의 금액으로 한다.
