도로교통법 제143조(전용차로 운행 등에 대한 시ㆍ군공무원의 단속)

① 시ㆍ군공무원은 제15조제3항에 따른 전용차로 통행 금지 의무, 제29조제4항ㆍ제5항에 따른 긴급자동차에 대한 진로양보 의무 또는 제32조부터 제34조까지의 규정에 따른 정차 및 주차 금지 의무를 위반한 운전자가 있으면 행정안전부령으로 정하는 바에 따라 현장에서 위반행위의 요지와 경찰서장(제주특별자치도의 경우 제주특별자치도지사로 한다. 이하 이 조에서 같다)에게 출석할 기일 및 장소 등을 구체적으로 밝힌 고지서를 발급하고, 운전면허증의 제출을 요구하여 이를 보관할 수 있다. 이 경우 그 고지서는 출석기일까지 운전면허증과 같은 효력이 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

② 시ㆍ군공무원은 제1항에 따라 고지서를 발급한 때에는 지체 없이 관할 경찰서장에게 운전면허증을 첨부하여 통보하여야 한다.

③ 경찰서장은 제2항에 따른 통보를 받으면 위반행위를 확인하여야 한다.

④ 시ㆍ군공무원은 제1항에 따라 고지서를 발급하거나 조치를 할 때에는 본래의 목적에서 벗어나 직무상 권한을 남용하여서는 아니 된다.
