도로교통법 제72조(도로의 지상 인공구조물 등에 대한 위험방지 조치)

① 경찰서장은 도로의 지상(地上) 인공구조물이나 그 밖의 시설 또는 물건이 교통에 위험을 일으키게 하거나 교통에 뚜렷이 방해될 우려가 있으면 그 인공구조물 등의 소유자ㆍ점유자 또는 관리자에게 그것을 제거하도록 하거나 그 밖에 교통안전에 필요한 조치를 명할 수 있다.

② 경찰서장은 인공구조물 등의 소유자ㆍ점유자 또는 관리자의 성명ㆍ주소를 알지 못하여 제1항에 따른 조치를 명할 수 없을 때에는 스스로 그 인공구조물 등을 제거하는 등 조치를 한 후 보관하여야 한다. 이 경우 닳아 없어지거나 파괴될 우려가 있거나 보관하는 것이 매우 곤란한 인공구조물 등은 매각하여 그 대금을 보관할 수 있다.

③ 제2항에 따른 인공구조물 등의 보관 및 매각 등에 필요한 사항은 대통령령으로 정한다.
