도로법 제81조(토지의 출입과 사용 등)

① 도로관리청 또는 도로관리청으로부터 명령이나 위임을 받은 자는 도로공사, 도로에 대한 조사ㆍ측량 또는 도로의 유지ㆍ관리를 위하여 필요하면 타인의 토지에 출입하거나 타인의 토지를 재료적치장, 통로 또는 임시도로로 일시 사용할 수 있고, 특히 필요하면 입목ㆍ죽이나 그 밖의 장애물을 변경 또는 제거할 수 있다.

② 제1항에 따라 타인의 토지에 출입하려는 자는 출입하려는 날의 3일 전까지 그 토지의 소유자와 점유자에게 그 사실을 알려야 하며, 타인의 토지를 일시 사용하거나 장애물을 변경ㆍ제거하려는 자는 토지를 사용하려는 날이나 장애물을 변경ㆍ제거하려는 날의 3일 전까지 그 소유자와 점유자에게 그 사실을 알리고 의견을 들어야 한다. 다만, 소유자와 점유자의 주소 또는 거소가 불분명하여 토지 출입 또는 장애물의 변경ㆍ제거 사실을 알릴 수 없거나, 그 밖에 부득이한 사유가 있으면 그러하지 아니하다.

③ 해가 뜨기 전이나 해가 진 뒤에는 해당 토지 점유자의 승낙 없이 그 주거(住居)나 경계표ㆍ담 등으로 둘러싸인 토지에 출입할 수 없다.

④ 토지의 소유자 및 점유자는 정당한 사유 없이 제1항에 따른 행위를 방해하거나 거부하지 못한다.

⑤ 제1항에 따라 타인의 토지에 출입하려는 자는 그 신분을 표시하는 증표를 지니고 이를 관계인에게 보여 주어야 한다.

⑥ 제5항에 따른 증표에 관하여 필요한 사항은 국토교통부령으로 정한다.
