도시 및 주거환경정비법 제44조(총회의 소집)

① 조합에는 조합원으로 구성되는 총회를 둔다.

② 총회는 조합장이 직권으로 소집하거나 조합원 5분의 1 이상(정관의 기재사항 중 제40조제1항제6호에 따른 조합임원의 권리ㆍ의무ㆍ보수ㆍ선임방법ㆍ변경 및 해임에 관한 사항을 변경하기 위한 총회의 경우는 10분의 1 이상으로 한다) 또는 대의원 3분의 2 이상의 요구로 조합장이 소집하며, 조합원 또는 대의원의 요구로 총회를 소집하는 경우 조합은 소집을 요구하는 자가 본인인지 여부를 대통령령으로 정하는 기준에 따라 정관으로 정하는 방법으로 확인하여야 한다. <개정 2019.4.23, 2023.7.18>

③ 제2항에도 불구하고 조합임원의 사임, 해임 또는 임기만료 후 6개월 이상 조합임원이 선임되지 아니한 경우에는 시장ㆍ군수등이 조합임원 선출을 위한 총회를 소집할 수 있다.

④ 제2항 및 제3항에 따라 총회를 소집하려는 자는 총회가 개최되기 7일 전까지 회의 목적ㆍ안건ㆍ일시 및 장소와 제45조제5항, 제6항 및 제8항에 따른 의결권의 행사기간 및 장소 등 의결권 행사에 필요한 사항을 정하여 조합원에게 통지하여야 한다. <개정 2021.8.10, 2024.12.3>

⑤ 총회의 소집 절차ㆍ시기 등에 필요한 사항은 정관으로 정한다.
