독점규제 및 공정거래에 관한 법률 제98조의2(전자정보처리조직을 통한 문서의 제출 및 송달)

① 당사자 등 대통령령으로 정하는 자(이하 이 조에서 "당사자등"이라 한다)는 이 법에 따른 심의에 필요한 문서와 그 밖에 대통령령으로 정하는 자료를 전자문서화하고 이를 정보통신망을 이용하여 공정거래위원회가 지정ㆍ운영하는 전자정보처리조직(이 법에 따른 심의에 필요한 전자문서를 작성ㆍ제출ㆍ송달할 수 있도록 하는 하드웨어, 소프트웨어, 데이터베이스, 네트워크, 보안요소 등을 결합하여 구축한 정보처리능력을 갖춘 전자적 장치를 말한다. 이하 같다)을 통하여 제출할 수 있다.

② 제1항에 따라 제출된 전자문서는 그 문서를 제출한 당사자등이 정보통신망을 통하여 전자정보처리조직에서 제공하는 접수번호를 확인하였을 때 전자정보처리조직에 기록된 내용으로 접수된 것으로 본다.

③ 공정거래위원회는 당사자등에게 전자정보처리조직과 그와 연계된 정보통신망을 이용하여 의결서 및 재결서와 그 밖에 이 법에 따른 심의에 필요한 문서를 송달할 수 있다. 다만, 당사자등이 동의하지 아니하는 경우에는 그러하지 아니하다.

④ 공정거래위원회는 제3항의 방법으로 문서를 송달하는 경우 해당 문서를 전자정보처리조직에 입력하여 등재한 후 그 등재 사실을 전자우편 등 대통령령으로 정하는 방법으로 당사자등에게 통지하여야 한다.

⑤ 제3항의 방법에 따른 문서의 송달은 당사자등이 제4항에 따라 등재된 전자문서를 확인하였을 때 전자정보처리조직에 기록된 내용으로 도달한 것으로 본다. 다만, 제4항에 따라 등재 사실이 통지된 날부터 2주 이내(의결서 및 재결서 외의 서류는 7일 이내)에 확인하지 아니하였을 때에는 그 등재 사실이 통지된 날부터 2주가 지난 날(의결서 및 재결서 외의 서류는 7일이 지난 날)에 도달한 것으로 본다.

⑥ 전자정보처리조직의 장애로 송달 또는 통지를 받을 자가 전자문서를 확인할 수 없는 기간은 제5항 단서의 기간에 산입하지 아니한다. 이 경우 전자문서를 확인할 수 없는 기간의 계산 방법은 대통령령으로 정한다.
