동물보호법 제36조(동물보호센터의 지정 등)

① 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 농림축산식품부령으로 정하는 시설 및 인력 기준에 맞는 기관이나 단체 등을 동물보호센터로 지정하여 제35조제3항에 따른 업무를 위탁할 수 있다. 이 경우 동물보호센터로 지정받은 기관이나 단체 등은 동물의 보호조치를 제3자에게 위탁하여서는 아니 된다.

② 제1항에 따른 동물보호센터로 지정받으려는 자는 농림축산식품부령으로 정하는 바에 따라 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 신청하여야 한다.

③ 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따른 동물보호센터에 동물의 구조ㆍ보호조치 등에 드는 비용(이하 "보호비용"이라 한다)의 전부 또는 일부를 지원할 수 있으며, 보호비용의 지급절차와 그 밖에 필요한 사항은 농림축산식품부령으로 정한다.

(3) A어 Mayor/Do메이어 Governor거^v버너 or오 the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 may메이 provide프^r러^v바이드 an앤 animal애너믈 shelter셸터 under언더 paragraph패^r러그^r래^f프 (1) with위^ð드 all올 or오 part파트 of어^v브 the^ð더 costs카스츠 of어^v브 rescue^r레스큐 and앤드 protective프^r러텍티^v브 measures메저즈 for^f포 animals,애너믈즈 etc.엣세터^r러 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "protection프^r러텍션 costs"),카스츠 and앤드 the^ð더 procedures프^r러시저즈 for^f포 paying페이잉 protection프^r러텍션 costs카스츠 and앤드 other어^ð더 necessary네서세^r리 matters매터즈 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Agriculture,애그^r리컬처 Food^f푸드 and앤드 Rural^r루^r럴 Affairs.어^f페어즈

④ 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따라 지정된 동물보호센터가 다음 각 호의 어느 하나에 해당하는 경우에는 그 지정을 취소할 수 있다. 다만, 제1호 및 제4호에 해당하는 경우에는 그 지정을 취소하여야 한다.

⑤ 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제4항에 따라 지정이 취소된 기관이나 단체 등을 지정이 취소된 날부터 1년 이내에는 다시 동물보호센터로 지정하여서는 아니 된다. 다만, 제4항제4호에 따라 지정이 취소된 기관이나 단체는 지정이 취소된 날부터 5년 이내에는 다시 동물보호센터로 지정하여서는 아니 된다.

(5) A어 Mayor/Do메이어 Governor거^v버너 or오 the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 shall섈 not낫 re-designate^r레이-데저그네잇 an앤 institution,인스티투션 organization,오거너제이션 etc.엣세터^r러 whose후즈 designation데저그네이션 has해즈 been빈 cancelled캔슬드 under언더 paragraph패^r러그^r래^f프 (4) as애즈 an앤 animal애너믈 shelter셸터 within위^ð딘 one원 year이어 from^f프^r럼 the^ð더 date데잇 of어^v브 cancellation:캔설레이션 Provided,프^r러^v바이디드 That^ð댓 an앤 institution인스티투션 or오 organization오거너제이션 whose후즈 designation데저그네이션 has해즈 been빈 cancelled캔슬드 under언더 paragraph패^r러그^r래^f프 (4) 4 shall섈 not낫 be비 re-designated^r레이-데지그네이티드 as애즈 an앤 animal애너믈 shelter셸터 within위^ð딘 five^f파이^v브 years이어즈 from^f프^r럼 the^ð더 date데잇 of어^v브 cancellation.캔설레이션

⑥ 제1항에 따른 동물보호센터 지정절차의 구체적인 내용은 시ㆍ도의 조례로 정하고, 지정된 동물보호센터에 대하여는 제35조제5항부터 제7항까지의 규정을 준용한다.
