디자인보호법 제99조(통상실시권)

① 디자인권자는 그 디자인권에 대하여 타인에게 통상실시권을 허락할 수 있다.

(1) A어 design디자인 right^r라잇 holder호울더 may메이 grant그^r랜트 a어 non-exclusive난-익스클루시^v브 license라이슨스 on안 the^ð더 design디자인 right^r라잇 to투 another어너^ð더 person.퍼슨

② 통상실시권자는 이 법에 따라 또는 설정행위로 정한 범위에서 그 등록디자인 또는 이와 유사한 디자인을 업으로서 실시할 수 있는 권리를 가진다.

(2) A어 non-exclusive난-익스클루시^v브 licensee라이선시 shall섈 have해^v브 the^ð더 right^r라잇 to투 work워크 the^ð더 registered^r레지스터드 design,디자인 or오 a어 design디자인 similar시멀러 to투 it,잇 as애즈 a어 business비즈니스 under언더 this^ð디스 Act액트 or오 within위^ð딘 the^ð더 scope스코우프 set셋 by바이 the^ð디 act액트 of어^v브 establishment.이스태블리시먼트

③ 제123조에 따른 통상실시권은 그 통상실시권자의 해당 디자인권ㆍ전용실시권 또는 통상실시권과 함께 이전되고 해당 디자인권ㆍ전용실시권 또는 통상실시권이 소멸되면 함께 소멸된다.

④ 제3항 외의 통상실시권은 실시사업과 같이 이전하는 경우 또는 상속이나 그 밖의 일반승계의 경우를 제외하고는 디자인권자(전용실시권자로부터 통상실시권을 허락받은 경우에는 디자인권자 및 전용실시권자)의 동의를 받지 아니하면 이전할 수 없다.

⑤ 제3항 외의 통상실시권은 디자인권자(전용실시권자로부터 통상실시권을 허락받은 경우에는 디자인권자 및 전용실시권자)의 동의를 받지 아니하면 그 통상실시권을 목적으로 하는 질권을 설정할 수 없다.

⑥ 통상실시권에 관하여는 제96조제2항ㆍ제3항을 준용한다.
