문화예술진흥법 제9조의3(미술작품의 관리 등)

① 건축주(미술작품의 소유자를 말하며, 이하 이 조에서 같다)는 제9조제1항에 따라 설치된 미술작품을 안전하게 관리하고 미술작품으로서의 가치가 유지될 수 있도록 노력하여야 한다.

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ자치구의 구청장(이하 "시장ㆍ군수ㆍ구청장"이라 한다)은 미술작품의 관리실태를 정기적으로 점검하여 그 결과를 기록ㆍ관리하여야 한다.

③ 시장ㆍ군수ㆍ구청장은 제2항에 따른 점검 결과 필요하다고 인정하는 경우에 해당 건축주에게 다음 각 호의 조치를 하게 할 수 있다. 이 경우 조치명령을 받은 건축주는 특별한 사유가 없으면 이에 따라야 한다.

④ 제2항에 따른 관리실태의 점검, 기록ㆍ관리 등에 필요한 사항은 대통령령으로 정한다.
