민법 제268조(공유물의 분할청구)

①공유자는 공유물의 분할을 청구할 수 있다. 그러나 5년내의 기간으로 분할하지 아니할 것을 약정할 수 있다.

②전항의 계약을 갱신한 때에는 그 기간은 갱신한 날로부터 5년을 넘지 못한다.

③전2항의 규정은 제215조, 제239조의 공유물에는 적용하지 아니한다.
