Enforcement Decree of the Military Service Act, Article 83 (Relevant Fields, etc. in Which Specialized Research Personnel and Industrial Technical Personnel Are to Serve)

① 법 제39조에 따른 전문연구요원 및 산업기능요원은 다음 각 호의 분야에 복무하여야 하며, 다른 직무를 겸할 수 없다. <개정 2012.12.20, 2013.12.4, 2016.11.29>

4. 수산업 및 해운업 분야의 기간산업체에 복무하는 산업기능요원: 원양ㆍ근해어선 또는 해운업의 선박승선 관련 분야 중 「선박직원법」에 따른 해기사의 면허 분야 또는 국가기술자격법령에 따른 해당 국가기술자격 분야(사회복무요원으로 복무 중인 사람 및 사회복무요원 소집 대상인 보충역으로서 산업기능요원에 편입된 사람은 선박승선 분야). 이 경우 승선복무 중 하선한 경우에는 3개월(「선원법」에 따른 유급 휴가기간은 포함하지 아니한다) 이내에 복무 중인 업체의 선박에 승선하여야 하며, 하선기간은 부득이한 사정이 없으면 의무복무기간 1년마다 통틀어 3개월을 초과할 수 없다.

② 전문연구요원이나 산업기능요원은 의무복무기간 중 병역지정업체가 경영악화 등으로 3개월 이상 임금이 체불되거나 부도발생 등으로 인하여 조업이 중단되어 제1항에 따른 해당 분야에 복무할 수 없을 때에는 그 사유가 발생한 날부터 30일 이내에 관할 지방병무청장에게 신고하여야 한다. <개정 2016.11.29>
