부패방지 및 국민권익위원회의 설치와 운영에 관한 법률 시행령 제72조(보상금의 지급사유)
Enforcement Decree of the Act on the Prevention of Corruption and the Establishment and Operation of the Anti-Corruption and Civil Rights Commission, Article 72 (Grounds for Paying Reward Money)
① 법 제68조제4항에 따라 보상금을 지급할 수 있는 경우는 다음 각 호의 어느 하나에 해당하는 부과 및 환수 등으로 인하여 직접적인 공공기관 수입의 회복이나 증대 또는 비용의 절감을 가져오거나 그에 관한 법률관계가 확정된 경우를 말한다. <개정 2019.10.15>
(1) Cases in which reward money may be paid pursuant to Article 68 (4) of the Act are cases where the recovery or increase of revenue of a public institution or the reduction of expenses has been directly brought about, or the legal relationship thereto has been finalized, through any of the following impositions and recoveries, etc.:
1. 몰수 또는 추징금의 부과
1. Imposition of forfeiture or additional collection;
2. 국세 또는 지방세의 부과
2. Imposition of national tax or local tax;
3. 손해배상 또는 부당이득 반환 등에 의한 환수
3. Recovery through damages or return of unjust enrichment, etc.;
4. 계약변경 등에 의한 비용절감
4. Reduction of expenses through contract changes, etc.;
5. 벌금ㆍ과료ㆍ과징금 또는 과태료의 부과와 통고처분
5. Imposition of a fine, minor fine, penalty surcharge, or administrative fine, and notification disposition;
6. 그 밖의 처분이나 판결
6. Other dispositions or judgments.
② 제1항 각 호의 어느 하나에 해당하는 부과 및 환수 등은 신고사항 및 증거자료 등과 직접적으로 관련된 것에 한한다.
(2) Impositions and recoveries, etc. falling under any subparagraph of paragraph (1) are limited to those directly related to the reported matters and evidentiary materials, etc.
