빈집 및 소규모주택 정비에 관한 특례법 제39조(준공인가 및 공사완료 고시)

① 시장ㆍ군수등이 아닌 사업시행자가 소규모주택정비사업 공사를 완료한 때에는 시장ㆍ군수등의 준공인가를 받아야 한다.

② 제1항에 따라 준공인가신청을 받은 시장ㆍ군수등은 지체 없이 준공검사를 실시하여야 한다. 이 경우 시장ㆍ군수등은 효율적인 준공검사를 위하여 필요한 때에는 관계 행정기관ㆍ공공기관ㆍ연구기관, 그 밖의 전문기관 또는 단체에 준공검사의 실시를 의뢰할 수 있다.

③ 시장ㆍ군수등은 제2항에 따른 준공검사를 실시한 결과 소규모주택정비사업이 인가받은 사업시행계획대로 완료되었다고 인정되는 때에는 준공인가를 하고 그 사실을 해당 지방자치단체의 공보에 고시하여야 한다.

④ 시장ㆍ군수등은 직접 시행하는 소규모주택정비사업에 관한 공사가 완료된 때에는 그 사실을 해당 지방자치단체의 공보에 고시하여야 한다.

⑤ 시장ㆍ군수등은 제1항에 따른 준공인가를 하기 전이라도 완공된 건축물이 사용에 지장이 없는 등 대통령령으로 정하는 기준에 적합한 경우에는 입주예정자가 완공된 건축물을 사용할 수 있도록 사업시행자에게 허가할 수 있다. 다만, 시장ㆍ군수등이 사업시행자인 경우에는 허가를 받지 아니하고 입주예정자가 완공된 건축물을 사용하게 할 수 있다.

⑥ 제3항 및 제4항에 따라 공사완료를 고시하는 경우 시장ㆍ군수등이 제55조에 따라 의제되는 인ㆍ허가등에 따른 준공검사ㆍ인가등에 관하여 관계 행정기관의 장과 협의한 사항은 해당 준공검사ㆍ인가등을 받은 것으로 본다.
