사립학교교직원 연금법 제41조(다른 법령에 따른 급여와의 조정)

① 다른 법령에 따라 학교경영기관의 부담으로 이 법에 따른 급여와 같은 종류의 급여를 받는 사람에게는 그 급여에 상당하는 금액을 이 법에 따른 급여에서 공제하여 지급한다. 이 경우에 공단은 공제한 금액을 학교경영기관에 지급하여야 한다.

② 이 법에 따른 급여의 사유가 제3자의 행위로 인하여 발생한 경우에는 공단은 그 급여 사유에 대하여 이미 지급한 급여액(장해연금 및 비직무상 장해연금의 경우에는 장해일시금 및 5년분의 비직무상 장해연금액에 상당하는 금액으로 산정한 금액)의 범위에서 수급권자가 제3자에 대하여 가지는 손해배상청구권을 취득한다. 다만, 제3자가 다음 각 호의 어느 하나에 해당하는 경우에는 급여심의회의 심의를 거쳐 손해배상청구권의 전부 또는 일부를 행사하지 아니할 수 있다. <개정 2018.3.20>

③ 제2항의 경우에 수급권자가 제3자로부터 같은 사유로 이미 손해배상을 받았을 때에는 그 배상액의 범위에서 급여를 지급하지 아니한다.
