산업기술의 유출방지 및 보호에 관한 법률 제36조(벌칙)

① 국가핵심기술이 외국에서 사용될 것을 알면서 제14조제1호부터 제12호까지의 어느 하나에 해당하는 행위를 한 자는 3년 이상의 유기징역에 처한다. 이 경우 65억원 이하의 벌금을 병과한다. <신설 2019.8.20, 2025.1.21>

②산업기술이 외국에서 사용될 것을 알면서 제14조제1호부터 제6호까지 및 제12호의 어느 하나에 해당하는 행위를 한 자(제1항에 해당하는 행위를 한 자는 제외한다)는 15년 이하의 징역 또는 30억원 이하의 벌금에 처한다. <개정 2008.3.14, 2016.3.29, 2019.8.20, 2025.1.21>

④제14조제12호 및 제13호의 어느 하나에 해당하는 행위를 한 자는 3년 이하의 징역 또는 3억원 이하의 벌금에 처한다. <개정 2019.8.20, 2025.1.21>

⑤제1항부터 제4항까지의 죄를 범한 자가 그 범죄행위로 인하여 얻은 재산은 이를 몰수한다. 다만, 그 전부 또는 일부를 몰수할 수 없는 때에는 그 가액을 추징한다. <개정 2019.8.20>

⑥제34조의 규정을 위반하여 비밀을 누설하거나 도용한 자는 5년 이하의 징역이나 10년 이하의 자격정지 또는 5천만원 이하의 벌금에 처한다. <개정 2016.3.29, 2019.8.20>
