새만금사업 추진 및 지원에 관한 특별법 제26조(국공유지의 처분제한 등)

① 새만금사업지역에 있는 국가 및 지방자치단체 소유의 토지로서 새만금사업에 필요한 토지는 새만금사업으로 정하여진 목적 외의 목적으로 매각 등 처분할 수 없다.

② 새만금사업지역에 있는 국가 및 지방자치단체 소유의 재산으로서 새만금사업에 필요한 재산은 「국유재산법」 및 「공유재산 및 물품 관리법」에도 불구하고 사업시행자에게 수의계약의 방법으로 매각 등 처분할 수 있다. 이 경우 그 재산의 용도폐지(행정재산의 경우에 한정한다) 및 매각 등 처분에 관하여는 해당 재산의 관리청이 미리 관계 중앙행정기관의 장과 협의하여야 한다.

③ 관계 중앙행정기관의 장은 제2항 후단에 따른 협의요청이 있는 경우에는 그 요청을 받은 날부터 60일 이내에 의견을 통지하여야 한다.

④ 국가 및 지방자치단체는 새만금사업지역에 있는 국유재산 또는 공유재산을 사업시행자에게 매각할 경우 개발여건을 고려하여 대통령령으로 정하는 바에 따라 장기분할 납부 등 그 조건을 일부 완화할 수 있다.
