새만금사업 추진 및 지원에 관한 특별법 제49조(특별건축구역 지정 등에 관한 특례)

① 새만금청장은 새만금사업을 위하여 필요하다고 인정하는 경우 「건축법」 제69조에도 불구하고 새만금사업지역의 일부를 특별건축구역으로 지정할 수 있다. <개정 2013.3.23, 2016.12.2>

② 제1항에 따른 특별건축구역의 지정 및 그 절차 등에 대하여는 「건축법」 제69조부터 제77조까지의 규정을 준용한다. 이 경우 "국토교통부장관"은 "새만금청장"으로 본다. <개정 2016.12.2>

③ 새만금청장은 「건축법」 제70조에도 불구하고 제8조제1항제4호 또는 제5호의 사업시행자가 건축하는 건축물을 특별건축구역에서 건축할 수 있는 건축물에 포함시킬 수 있다. <개정 2013.3.23, 2016.12.2>

④ 새만금청장은 제1항 및 제3항에 따라 특별건축구역을 지정하거나 특별건축구역에서 건축할 수 있는 건축물에 포함시키는 경우에는 미리 국토교통부장관과 협의하여야 한다. <신설 2016.12.2>
