소방공무원법 제29조(징계 절차)

① 소방공무원의 징계는 관할 징계위원회의 의결을 거쳐 그 징계위원회가 설치된 기관의 장이 하되, 「국가공무원법」에 따라 국무총리 소속으로 설치된 징계위원회에서 의결한 징계는 소방청장이 한다. 다만, 파면과 해임은 관할 징계위원회의 의결을 거쳐 그 소방공무원의 임용권자(임용권을 위임받은 사람은 제외한다)가 한다.

② 제1항에도 불구하고 제6조제3항 및 같은 조 제4항에 따라 시ㆍ도지사가 임용권을 행사하는 소방공무원의 징계는 관할 징계위원회의 의결을 거쳐 임용권자가 한다. 다만, 시ㆍ도 소속 소방기관에 설치된 소방공무원 징계위원회에서 의결한 정직ㆍ감봉 및 견책은 그 징계위원회가 설치된 기관의 장이 한다.

③ 소방공무원의 징계의결을 요구한 기관의 장은 관할 징계위원회의 의결이 경(輕)하다고 인정할 때에는 그 처분을 하기 전에 직근(直近) 상급기관에 설치된 징계위원회(다음 각 호의 어느 하나에 해당하는 징계위원회의 의결에 대해서는 그 구분에 따른 징계위원회를 말한다)에 심사 또는 재심사를 청구할 수 있다. 이 경우 소속 공무원을 대리인으로 지정할 수 있다.
