소음ㆍ진동관리법 시행규칙 제21조(특정공사의 사전신고 등)

Enforcement Rule of the Noise and Vibration Control Act, Article 21 (Advance Reports on Specified Construction)

①법 제22조제1항에서 "기후에너지환경부령으로 정하는 특정공사"란 별표 9의 기계ㆍ장비를 5일 이상 사용하는 공사로서 다음 각 호의 어느 하나에 해당하는 공사를 말한다. 다만, 별표 9의 기계ㆍ장비로서 기후에너지환경부장관이 저소음ㆍ저진동을 발생하는 기계ㆍ장비라고 인정하는 기계ㆍ장비를 사용하는 공사와 제20조제1항에 따른 지역에서 시행되는 공사는 제외한다. <개정 2019.12.20, 2025.10.1>

②법 제22조제1항에 따라 특정공사를 시행하려는 자(도급에 의하여 공사를 시행하는 경우에는 발주자로부터 최초로 공사를 도급받은 자를 말한다)는 해당 공사 시행 전(건설공사는 착공 전)까지 별지 제10호서식의 특정공사 사전신고서에 다음 각 호의 서류를 첨부하여 특별자치시장ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장에게 제출하여야 한다. 다만, 둘 이상의 특별자치시 또는 시ㆍ군ㆍ구(자치구를 말한다. 이하 같다)에 걸쳐있는 건설공사의 경우에는 해당 공사지역의 면적이 가장 많이 포함되는 지역을 관할하는 특별자치시장ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <개정 2007.12.31, 2010.6.30, 2014.1.6>

③ 제2항에 따라 신고를 받은 특별자치시장ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장은 별지 제11호서식의 특정공사 사전신고증명서를 신고인에게 내주어야 한다. 이 경우 둘 이상의 특별자치시 또는 시ㆍ군ㆍ구에 걸쳐있는 건설공사의 경우에는 다른 공사지역을 관할하는 특별자치시장ㆍ시장ㆍ군수ㆍ구청장에게 그 신고내용을 알려야 한다. <개정 2007.12.31, 2010.6.30, 2014.1.6>

⑤법 제22조제2항에 따라 변경신고를 하려는 자는 별지 제12호서식의 특정공사 변경신고서에 다음 각 호의 서류를 첨부하여 특별자치시장ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장에게 제출해야 한다. 다만, 제4항제2호에 해당하는 경우에는 제3항에 따른 사전신고증명서의 특정공사 기간이 종료되기 전까지 제출해야 한다. <개정 2009.1.14, 2010.6.30, 2014.1.6, 2019.12.31>
