여객자동차 운수사업법 제38조(공사시행 인가 등)

① 제36조제1항에 따라 터미널사업의 면허를 받은 자(이하 "터미널사업자"라 한다)는 시설하려는 터미널의 공사계획을 수립하여 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ자치구의 구청장(이하 "시장ㆍ군수ㆍ구청장"이라 한다)이 정하는 기간까지 공사시행 인가를 받아야 한다. 인가받은 사항 중 대통령령으로 정하는 사항을 변경하려는 경우에도 또한 같다. <개정 2020.2.18>

② 시장ㆍ군수ㆍ구청장은 제1항의 공사계획이 국토교통부령으로 정하는 구조와 설비기준 등에 적합하다고 인정하면 공사시행을 인가하여야 한다. <개정 2013.3.23, 2020.2.18>

③ 시장ㆍ군수ㆍ구청장은 터미널사업자가 천재지변이나 그 밖의 부득이한 사유로 제1항에 따른 기간까지 인가를 신청할 수 없으면 터미널사업자의 신청에 따라 그 기간을 연장할 수 있다. <개정 2020.2.18>
