영유아보육법 제25조(어린이집운영위원회)

① 어린이집의 원장은 어린이집 운영의 자율성과 투명성을 높이고 지역사회와의 연계를 강화하여 지역 실정과 특성에 맞는 보육을 실시하기 위하여 어린이집에 어린이집운영위원회를 설치ㆍ운영할 수 있다. 다만, 제26조에 따른 취약보육(脆弱保育)을 우선적으로 실시하여야 하는 어린이집과 대통령령으로 정하는 어린이집은 어린이집운영위원회를 설치ㆍ운영하여야 한다. <개정 2011.6.7>

② 어린이집운영위원회는 그 어린이집의 원장, 보육교사 대표, 학부모 대표 및 지역사회 인사(직장어린이집의 경우에는 그 직장의 어린이집 업무 담당자로 한다)로 구성한다. 이 경우 학부모 대표가 2분의 1 이상이 되도록 구성하여야 한다. <개정 2011.6.7, 2015.5.18>

③ 어린이집의 원장은 어린이집운영위원회의 위원 정수를 5명 이상 15명 이내의 범위에서 어린이집의 규모 등을 고려하여 대통령령으로 정한다. 이 경우 학부모 대표는 영유아 연령 등을 최대한 대표할 수 있도록 구성하여야 한다. <개정 2011.6.7, 2020.12.29>

⑤ 어린이집운영위원회는 연간 4회 이상 개최하여야 한다. <신설 2015.5.18>
