영유아보육법 시행령 제20조(직장어린이집의 설치)

① 법 제14조제1항에 따라 사업주가 직장어린이집을 설치하여야 하는 사업장은 상시 여성근로자 300명 이상 또는 상시근로자 500명 이상을 고용하고 있는 사업장으로 한다. <개정 2011.12.8>

② 제1항을 적용하는 경우 둘 이상의 국가행정기관이 청사를 공동으로 사용하면 이를 하나의 사업장으로 본다.

③ 제2항에 따라 직장어린이집을 설치하여야 하는 경우 그 설치ㆍ관리를 주관하는 기관은 다음 각 호의 순서에 따른다. 다만, 청사를 공동으로 사용하는 기관 간의 협의를 통하여 달리 정할 수 있다. <개정 2011.12.8>

④ 제2항 및 제3항에 따라 설치되는 직장어린이집의 운영에 필요한 비용은 그 어린이집을 이용하는 영유아의 수에 비례하여 각 기관이 부담한다. 다만, 부득이한 사유로 비용 분담을 조정할 필요가 있는 경우에는 설치ㆍ관리를 주관하는 기관과 이용 기관이 협의하여 정한다. <개정 2011.12.8>

⑤ 제1항 및 제2항에 따른 사업장 외의 사업주는 필요한 경우에는 사업장 근로자의 자녀를 보육하기 위한 직장어린이집을 설치할 수 있다. <개정 2011.12.8, 2014.12.30>
