예금자보호법 제21조의4(금융거래정보등의 제공 요구)

① 사장은 제21조의2제1항부터 제4항까지의 규정에 따른 손해배상청구의 요구, 손해배상청구권의 대위행사 및 소송참가와 같은 조 제7항에 따른 조사와 관련하여 금융거래의 내용에 대한 정보 또는 자료(이하 "금융거래정보등"이라 한다)에 의하지 아니하고는 부실관련자의 손해배상책임이나 부실관련자 또는 그 이해관계인의 재산은닉 등의 여부를 확인할 수 없다고 인정하는 경우에는 「금융실명거래 및 비밀보장에 관한 법률」 제4조에도 불구하고 같은 법 제2조제1호에 따른 금융회사등의 장이나 그 특정점포에 부실관련자(제21조의2제1항에 따른 부실관련자 중 그 밖의 제3자는 제외한다) 또는 그 이해관계인에 대한 금융거래정보등의 제공을 요구할 수 있다. 이 경우 요구를 받은 금융회사등의 장이나 그 특정점포는 이에 따라야 한다.

② 제1항에 따른 금융거래정보등의 제공 요구는 필요한 최소한에 그쳐야 한다.

③ 제1항에 따라 사장이 금융회사등의 장이나 그 특정점포에 금융거래정보등을 요구하는 경우에는 「금융실명거래 및 비밀보장에 관한 법률」 제4조제6항, 제4조의2제5항 및 제4조의3제3항을 준용한다.
