①법 제12조제1항에 따라 원자력사업자는 다음 각 호의 구분에 따라 원자력안전위원회의 검사를 받아야 한다. <개정 2008.2.29, 2011.10.25, 2014.11.19, 2021.6.8>

1. 최초검사 : 핵물질, 방사성물질 또는 방사성폐기물을 원자력시설에 반입하기 전에 해당 원자력시설에 대한 방호에 관한 검사. 다만, 해당 시설 본래의 이용 목적이 아닌 「비파괴검사기술의 진흥 및 관리에 관한 법률」 제2조에 따른 비파괴검사 등을 위하여 방사성물질을 반입하는 경우는 제외한다.

4. 특별검사 : 다음 각목의 1에 해당하는 경우 당해 원자력시설등에 대한 물리적방호에 관한 검사

②원자력안전위원회는 법 제12조제1항에 따라 검사를 함에 있어서 국가정보원장의 요청이 있는 경우에는 「보안업무규정」 제35조 또는 제38조의 규정에 의한 보안측정의 실시 또는 보안사고 조사와 연계하여 검사를 할 수 있다. <개정 2005.11.11, 2008.2.29, 2011.10.25, 2014.11.19, 2015.3.11, 2020.1.14>
