자동차손해배상 보장법 제17조(자동차보험진료수가분쟁심의회)

① 보험회사등과 의료기관은 서로 협의하여 자동차보험진료수가와 관련된 분쟁의 예방 및 신속한 해결을 위한 다음 각 호의 업무를 수행하기 위하여 자동차보험진료수가분쟁심의회(이하 "심의회"라 한다)를 구성하여야 한다. <개정 2021.7.27>

(1) Insurance인슈^r런스 companies,컴퍼니즈 etc.엣세터^r러 and앤드 medical메더클 institutions인스티투션즈 shall,섈 through^θ쓰^r루 mutual뮤추얼 consultation,칸설테이션 form^f폼 an앤 Automobile오터모빌 Insurance인슈^r런스 Medical메더클 Fee^f피 Dispute디스퓻 Review^r리^v뷰 Committee커미티 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "Review^r리^v뷰 Committee")커미티 to투 perform퍼^f폼 the^ð더 following^f팔로잉 duties두티즈 for^f포 preventing프^r리^v벤팅 and앤드 promptly프^r람프틀리 resolving^r리잘^v빙 disputes디스퓻츠 related^r릴레이티드 to투 automobile오터모빌 insurance인슈^r런스 medical메더클 fees:^f피즈

② 심의회는 위원장을 포함한 18명의 위원으로 구성한다.

(2) The^ð더 Review^r리^v뷰 Committee커미티 shall섈 be비 composed컴포우즈드 of어^v브 18 members,멤버즈 including인클루딩 the^ð더 chairperson.체어퍼슨

③ 위원은 국토교통부장관이 위촉하되, 6명은 보험회사등의 단체가 추천한 자 중에서, 6명은 의료사업자단체가 추천한 자 중에서, 6명은 대통령령으로 정하는 요건을 갖춘 자 중에서 각각 위촉한다. 이 중 대통령령으로 정하는 요건을 갖추어 국토교통부장관이 위촉한 위원은 보험회사등 및 의료기관의 자문위원 등 심의회 업무의 공정성을 해칠 수 있는 직을 겸하여서는 아니 된다. <개정 2012.2.22, 2013.3.23>

④ 위원장은 위원 중에서 호선한다.

(4) The^ð더 chairperson체어퍼슨 shall섈 be비 elected일렉티드 by바이 and앤드 from^f프^r럼 among어멍 the^ð더 members.멤버즈

⑤ 위원의 임기는 2년으로 하되, 연임할 수 있다. 다만, 보궐위원의 임기는 전임자의 남은 임기로 한다.

⑥ 심의회의 구성ㆍ운영 등에 필요한 세부사항은 대통령령으로 정한다.
