Enforcement Decree of the Guarantee of Automobile Accident Compensation Act, Article 33-13 (Exclusion, Challenge, and Recusal of Members)

① 사고조사위원회의 위원이 다음 각 호의 어느 하나에 해당하는 경우 사고조사위원회의 심의ㆍ의결에서 제척된다.

(1) A어 member멤버 of어^v브 the^ð디 Accident액서던트 Investigation인^v베스터게이션 Committee커미티 shall섈 be비 excluded익스클루디드 from^f프^r럼 the^ð더 deliberation딜리버^r레이션 and앤드 resolution^r레절루션 of어^v브 the^ð디 Accident액서던트 Investigation인^v베스터게이션 Committee커미티 in인 any에니 of어^v브 the^ð더 following^f팔로잉 cases:케이시즈

1. 위원이나 그 배우자 또는 배우자였던 사람이 자율주행자동차사고의 당사자(자율주행자동차의 보유자인 경우를 포함한다. 이하 "당사자등"이라 한다)인 경우

4. 위원 또는 위원이 속한 법인 또는 단체가 최근 3년 이내에 해당 자율주행자동차의 제작ㆍ조립ㆍ수입 또는 보험ㆍ공제와 관련된 자문, 연구 또는 용역을 수행한 경우

5. 위원이 해당 자율주행자동차의 제작자등 또는 해당 자율주행자동차사고로 인하여 보험금등을 지급해야 하는 보험회사등의 임직원으로 재직했던 경우

6. 위원이 당사자등, 해당 자율주행자동차의 제작자등 또는 해당 자율주행자동차사고로 인하여 보험금등을 지급해야 하는 보험회사등의 대리인이거나 대리인이었던 경우

② 자율주행자동차사고에 이해관계가 있는 자는 위원에게 공정한 심의ㆍ의결을 기대하기 어려운 사정이 있는 경우에는 사고조사위원회에 기피신청을 할 수 있다.

(2) A어 person퍼슨 with위^ð드 an앤 interest인트^r리스트 in인 an앤 autonomous오타너머스 vehicle^v비히클 accident액서던트 may메이 file^f파일 a어 challenge챌런지 against어겐스트 a어 member멤버 with위^ð드 the^ð디 Accident액서던트 Investigation인^v베스터게이션 Committee커미티 where웨어 there^ð데어 are아 circumstances서컴스탠시즈 under언더 which위치 a어 fair^f페어 deliberation딜리버^r레이션 and앤드 resolution^r레절루션 cannot캐낫 be비 expected익스펙티드 of어^v브 the^ð더 member.멤버

③ 사고조사위원회는 제2항에 따른 기피신청을 받은 경우 의결로 기피 여부를 결정한다. 이 경우 기피 신청의 대상인 위원은 그 의결에 참여하지 못한다.

④ 위원은 제1항 각 호에 따른 제척사유에 해당하는 경우에는 스스로 해당 안건의 심의ㆍ의결에서 회피하여야 한다.
