장애인복지법 제59조의12(사후관리 등)

① 장애인권익옹호기관의 장은 장애인학대가 종료된 후에도 가정방문, 시설방문, 전화상담 등을 통하여 장애인학대의 재발 여부를 확인하여야 한다.

② 장애인권익옹호기관의 장은 장애인학대가 종료된 후에도 피해장애인의 안전 확보, 장애인학대의 재발 방지, 건전한 가정기능의 유지 등을 위하여 피해장애인, 피해장애인의 보호자(친권자, 「민법」에 따른 후견인, 장애인을 보호ㆍ양육ㆍ교육하거나 그러한 의무가 있는 사람 또는 업무ㆍ고용 등의 관계로 사실상 장애인을 보호ㆍ감독하는 사람을 말한다. 이하 이 조에서 같다)ㆍ가족 및 장애인학대행위자에게 상담, 교육 및 의료적ㆍ심리적 치료 등의 지원을 하여야 한다. <개정 2021.8.17>

③ 장애인권익옹호기관의 장은 제2항에 따른 지원을 하기 위하여 관계 기관ㆍ법인ㆍ단체ㆍ시설에 협조를 요청할 수 있다.

(3) The^ð더 head헤드 of어^v브 an앤 agency에이전시 for^f포 protecting프^r러텍팅 the^ð더 rights^r라잇츠 of어^v브 persons퍼슨즈 with위^ð드 disabilities디서빌러티즈 may메이 request^r리퀘스트 cooperation코아퍼^r레이션 from^f프^r럼 relevant^r렐러^v번트 institutions,인스티투션즈 corporations,코퍼^r레이션즈 organizations,오거너제이션즈 and앤드 facilities^f퍼실러티즈 in인 order오더 to투 provide프^r러^v바이드 support서포트 under언더 paragraph패^r러그^r래^f프 (2).

④ 장애인권익옹호기관의 장은 제2항에 따른 지원을 할 때에는 피해장애인의 이익을 최우선으로 고려하여야 한다.

(4) When웬 providing프^r러^v바이딩 support서포트 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 head헤드 of어^v브 an앤 agency에이전시 for^f포 protecting프^r러텍팅 the^ð더 rights^r라잇츠 of어^v브 persons퍼슨즈 with위^ð드 disabilities디서빌러티즈 shall섈 give기^v브 top탑 priority프^r라이오^r러티 to투 the^ð디 interests인트^r러스츠 of어^v브 the^ð더 victimized^v빅터마이즈드 person퍼슨 with위^ð드 a어 disability.디서빌리티

⑤ 피해장애인의 보호자ㆍ가족 및 장애인학대행위자는 제2항에 따른 장애인권익옹호기관의 지원에 참여하여야 하고, 제1항 및 제2항에 따른 장애인권익옹호기관의 업무 수행을 정당한 사유 없이 거부하거나 방해하여서는 아니 된다. <개정 2017.12.19, 2021.8.17>

(5) The^ð더 guardians가디언즈 and앤드 family^f패멀리 members멤버즈 of어^v브 a어 victimized^v빅터마이즈드 person퍼슨 with위^ð드 a어 disability디서빌리티 and앤드 the^ð디 abuser어뷰저 shall섈 take테이크 part파트 in인 the^ð더 support서포트 provided프^r러^v바이디드 by바이 the^ð디 agency에이전시 for^f포 protecting프^r러텍팅 the^ð더 rights^r라잇츠 of어^v브 persons퍼슨즈 with위^ð드 disabilities디서빌러티즈 under언더 paragraph패^r러그^r래^f프 (2), and앤드 shall섈 not낫 refuse^r러^f퓨즈 or오 obstruct,어브스트^r럭트 without위^ð다웃 a어 justifiable저스터^f파이어블 reason,^r리즌 the^ð더 performance퍼^f포먼스 of어^v브 the^ð더 duties두티즈 of어^v브 the^ð디 agency에이전시 for^f포 protecting프^r러텍팅 the^ð더 rights^r라잇츠 of어^v브 persons퍼슨즈 with위^ð드 disabilities디서빌러티즈 under언더 paragraphs패^r러그^r래^f프스 (1) and앤드 (2).
