재건축초과이익 환수에 관한 법률 시행령 제14조(재건축부담금의 사전징수 및 예치를 위한 계좌의 개설 등)

①납부의무자가 법 제19조제2항에 따라 재건축부담금을 사전에 징수하여 예치하기 위한 계좌를 개설하려는 경우 납부의무자는 국토교통부장관에게 재건축부담금의 사전징수를 위한 계좌의 개설을 신청할 수 있다. <개정 2008.2.29, 2013.3.23>

②제1항에 따라 계좌의 개설을 신청받은 국토교통부장관은 신청일부터 7일 이내에 「주택도시기금법」 제10조제2항 및 제3항에 따라 주택도시기금 운용ㆍ관리에 관한 사무를 위탁받거나 재위탁받은 자로서 해당 재건축사업이 시행되는 지역에 있는 금융기관에 해당 조합등과 국토교통부장관의 공동명의로 계좌를 개설하여야 한다. 다만, 재건축부담금의 결정 및 부과 권한이 시장ㆍ군수ㆍ구청장에게 위임된 경우에는 조합등과 시장ㆍ군수ㆍ구청장의 공동명의로 개설하여야 한다. <개정 2008.2.29, 2013.3.23, 2015.6.30, 2017.9.5, 2018.2.9, 2024.3.26>

③법 제19조제1항 및 제2항에 따라 사전 징수하여 예치된 재건축부담금은 주택도시기금으로 귀속된다. <개정 2015.6.30>

④법 제19조제3항에서 "대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다. <개정 2021.2.19>
