재건축초과이익 환수에 관한 법률 시행령 제8조(정상주택가격상승분의 산정)

①국토교통부장관은 법 제10조제1항에 따라 금융기관의 1년 만기 정기예금 평균이자율을 고려하여 정기예금 이자율을 산정ㆍ고시한다. <개정 2008.2.29, 2013.3.23>

②법 제10조제2항 단서에 따라 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ자치구(이하 "시ㆍ군ㆍ구"라 한다)의 주택가격 통계가 생산되기 이전 기간의 평균주택가격상승률은 국토교통부장관이 한국부동산원에 의뢰하여 조사ㆍ산정한 내용을 기초로 중앙부동산가격공시위원회의 심의를 거쳐 결정한다. <개정 2008.2.29, 2009.7.27, 2013.3.23, 2016.8.31, 2017.9.5, 2020.12.8>

④법 제10조제1항에 따른 정상주택가격상승분은 그 산정기간이 1개월 미만인 월에 대해서는 정기예금 이자율 또는 해당 시ㆍ군ㆍ구의 평균주택가격상승률을 일 단위로 안분 적용하여 산정한다. <개정 2017.9.5, 2021.2.19>
