재난 및 안전관리 기본법 제69조(재난원인조사)

① 행정안전부장관은 재난이나 그 밖의 각종 사고의 발생 원인과 재난 발생 시 대응과정에 관한 조사ㆍ분석ㆍ평가(제34조의5제1항에 따른 위기관리 매뉴얼의 준수 여부에 대한 평가를 포함한다. 이하 "재난원인조사"라 한다)가 필요하다고 인정하는 경우 직접 재난원인조사를 실시하거나, 재난관리책임기관의 장으로 하여금 재난원인조사를 실시하고 그 결과를 제출하게 할 수 있다. <개정 2017.1.17, 2017.7.26>

② 행정안전부장관은 다음 각 호의 어느 하나에 해당하는 재난의 경우에는 재난안전 분야 전문가 및 전문기관 등이 공동으로 참여하는 정부합동 재난원인조사단(이하 "재난원인조사단"이라 한다)을 편성하고, 이를 현지에 파견하여 재난원인조사를 실시할 수 있다. <신설 2017.1.17, 2017.7.26>

③ 재난원인조사단은 대통령령으로 정하는 바에 따라 재난원인조사 결과를 조정위원회에 보고하여야 한다. <개정 2014.12.30, 2017.1.17>

④ 행정안전부장관은 재난원인조사를 위하여 필요하면 관계 기관의 장 또는 관계인에게 소속직원의 파견(관계 기관의 장에 대한 요청의 경우로 한정한다), 관계 서류의 열람 및 자료제출 등의 요청을 할 수 있다. 이 경우 요청을 받은 관계 기관의 장 또는 관계인은 특별한 사유가 없으면 요청에 따라야 한다. <개정 2017.1.17, 2017.7.26>

⑤ 행정안전부장관은 제1항 및 제2항에 따라 실시한 재난원인조사 결과 개선 등이 필요한 사항에 대해서는 관계 기관의 장에게 그 결과를 통보하거나 개선권고 등의 필요한 조치를 요청할 수 있다. 이 경우 요청을 받은 관계 기관의 장은 대통령령으로 정하는 바에 따라 개선권고 등에 따른 조치계획과 조치결과를 행정안전부장관에게 통보하여야 한다. <개정 2014.11.19, 2017.1.17, 2017.7.26>

⑥ 행정안전부장관은 재난원인조사단의 재난원인조사 결과를 신속히 국회 소관 상임위원회에 제출ㆍ보고하여야 한다. <신설 2014.12.30, 2017.1.17, 2017.7.26>
