전기통신사업법 제42조(정보의 제공)

① 기간통신사업자는 다른 전기통신사업자로부터 설비등의 제공ㆍ도매제공ㆍ상호접속 또는 공동사용 등이나 요금의 부과ㆍ징수 및 전기통신번호 안내를 위하여 필요한 기술적 정보 또는 이용자의 인적사항에 관한 정보의 제공을 요청받으면 협정을 체결하여 요청받은 정보를 제공할 수 있다.

② 과학기술정보통신부장관은 제1항에 따른 정보 제공의 범위와 조건ㆍ절차ㆍ방법 및 대가의 산정 등에 관한 기준을 정하여 고시한다. <개정 2013.3.23, 2017.7.26>

③ 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 기간통신사업자는 제1항에 따른 요청을 받으면 협정을 체결하여 요청받은 정보를 제공하여야 한다.

④ 제3항에 따른 기간통신사업자는 그 전기통신설비에 다른 전기통신사업자나 이용자가 단말기기나 그 밖의 전기통신설비를 접속하여 사용하는 데에 필요한 기술적 기준, 이용 및 공급 기준, 그 밖에 공정한 경쟁환경을 조성하기 위하여 필요한 기준을 정하여 과학기술정보통신부장관의 승인을 받아 공시하여야 한다. <개정 2013.3.23, 2017.7.26>

⑤ 이동통신사업자는 이용자가 해당 이동통신사업자를 거치지 아니하고 구입하는 이동통신단말장치의 제조, 수입, 유통 또는 판매를 위하여 필요한 범위에서 제조업자, 수입업자 또는 유통업자의 요청이 있을 경우 전기통신서비스 규격에 관한 정보를 제공하여야 한다. <신설 2013.8.13, 2025.1.21>

⑥ 제5항에 따른 정보 제공의 범위 및 방법 등에 필요한 사항은 대통령령으로 정한다. <신설 2013.8.13>
