주택법 시행령 제17조(등록사업자의 주택건설공사 시공기준)

Enforcement Decree of the Housing Act, Article 17 (Standards for Registered Business Operators Carrying Out Housing Construction Work)

① 법 제7조에 따라 주택건설공사를 시공하려는 등록사업자는 다음 각 호의 요건을 모두 갖추어야 한다. <개정 2018.12.11, 2019.10.22>

1. 자본금이 5억원(개인인 경우에는 자산평가액 10억원) 이상일 것

2. 「건설기술 진흥법 시행령」 별표 1에 따른 건축 분야 및 토목 분야 기술인 3명 이상을 보유하고 있을 것. 이 경우 「건설기술 진흥법 시행령」 별표 1에 따른 건설기술인으로서 다음 각 목에 해당하는 건설기술인 각 1명이 포함되어야 한다.

② 법 제7조에 따라 등록사업자가 건설할 수 있는 주택은 주택으로 쓰는 층수가 5개층 이하인 주택으로 한다. 다만, 각층 거실의 바닥면적 300제곱미터 이내마다 1개소 이상의 직통계단을 설치한 경우에는 주택으로 쓰는 층수가 6개층인 주택을 건설할 수 있다.

③ 제2항에도 불구하고 다음 각 호의 어느 하나에 해당하는 등록사업자는 주택으로 쓰는 층수가 6개층 이상인 주택을 건설할 수 있다.

④ 법 제7조에 따라 주택건설공사를 시공하는 등록사업자는 건설공사비(총공사비에서 대지구입비를 제외한 금액을 말한다)가 자본금과 자본준비금ㆍ이익준비금을 합한 금액의 10배(개인인 경우에는 자산평가액의 5배)를 초과하는 건설공사는 시공할 수 없다.
