주택법 시행령 제92조(분양권 전매 등에 대한 신고포상금)

① 법 제92조에 따라 법 제64조를 위반하여 분양권 등을 전매하거나 알선하는 행위(이하 "부정행위"라 한다)를 하는 자를 신고하려는 자는 신고서에 부정행위를 입증할 수 있는 자료를 첨부하여 시ㆍ도지사에게 신고하여야 한다.

② 시ㆍ도지사는 제1항에 따른 신고를 받은 경우에는 관할 수사기관에 수사를 의뢰하여야 하며, 수사기관은 해당 수사결과(법 제101조제2호에 따른 벌칙 부과 등 확정판결의 결과를 포함한다. 이하 같다)를 시ㆍ도지사에게 통보하여야 한다.

(2) Upon어판 receiving^r러시^v빙 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 Mayor/Do메이어 Governor거^v버너 shall섈 request^r리퀘스트 the^ð더 competent캄퍼틴트 investigative인^v베스터게이티^v브 agency에이전시 to투 investigate,인^v베스터게잇 and앤드 the^ð디 investigative인^v베스터게이티^v브 agency에이전시 shall섈 notify노우터^f파이 the^ð더 Mayor/Do메이어 Governor거^v버너 of어^v브 the^ð더 results^r리절츠 of어^v브 the^ð디 investigation인^v베스터게이션 (including인클루딩 the^ð디 outcome아웃컴 of어^v브 a어 final^f파이늘 judgment,저지먼트 such서치 as애즈 the^ð디 imposition임퍼지션 of어^v브 a어 penalty페널티 under언더 Article아터클 101, subparagraph서브패^r러그^r래^f프 2 of어^v브 the^ð디 Act;액트 the^ð더 same세임 applies어플라이즈 hereinafter).히^r리내^f프터

③ 시ㆍ도지사는 제2항에 따른 수사결과를 신고자에게 통지하여야 한다.

(3) The^ð더 Mayor/Do메이어 Governor거^v버너 shall섈 notify노우터^f파이 the^ð더 reporting^r리포팅 person퍼슨 of어^v브 the^ð더 results^r리절츠 of어^v브 the^ð디 investigation인^v베스터게이션 under언더 paragraph패^r러그^r래^f프 (2).

④ 제3항에 따른 통지를 받은 신고자는 신청서에 다음 각 호의 서류를 첨부하여 시ㆍ도지사에게 포상금 지급을 신청할 수 있다. 이 경우 시ㆍ도지사는 신청일부터 30일 이내에 국토교통부령으로 정하는 지급기준에 따라 포상금을 지급하여야 한다.
