지방자치법 제91조(의원의 자격심사)

① 지방의회의원은 다른 의원의 자격에 대하여 이의가 있으면 재적의원 4분의 1 이상의 찬성으로 지방의회의 의장에게 자격심사를 청구할 수 있다.

② 심사 대상인 지방의회의원은 자기의 자격심사에 관한 회의에 출석하여 의견을 진술할 수 있으나, 의결에는 참가할 수 없다.
