초ㆍ중등교육법 제31조의3(결격사유 확인을 위한 범죄경력 등 조회)

① 학교의 장은 학교운영위원회 위원 후보자에 대하여 제31조의2제1항에 따른 결격사유에 해당하는지를 확인하기 위하여 본인의 동의를 받아 해당 소재지를 관할하는 경찰관서 등 관계 기관의 장에게 범죄경력 등 필요한 자료를 요청할 수 있다.

② 학교의 장은 학교운영위원회 위원에 대하여 제31조의2제2항에 따른 당연퇴직 사유가 새로이 발생하였다고 볼 만한 상당한 사정이 있는 경우 당연퇴직 사유에 해당하는지를 확인하기 위하여 본인의 동의를 받아 해당 소재지를 관할하는 경찰관서 등 관계 기관의 장에게 범죄경력 등 필요한 자료를 요청할 수 있다.

③ 제1항과 제2항에 따른 범죄경력 등의 조회 요청을 받은 경찰관서 등 관계 기관의 장은 정당한 사유가 없으면 이에 따라야 한다.

④ 학교운영위원회 위원이 제2항에 따른 동의를 하지 아니하는 경우 해당 위원은 당연히 퇴직한다.

⑤ 제1항 및 제2항에 따른 범죄경력 등 조회 요청의 절차ㆍ범위 등에 필요한 사항은 대통령령으로 정한다.
