콘텐츠산업 진흥법 제37조(금지행위 등)

① 누구든지 정당한 권한 없이 콘텐츠제작자가 상당한 노력으로 제작하여 대통령령으로 정하는 방법에 따라 콘텐츠 또는 그 포장에 제작연월일, 제작자명 및 이 법에 따라 보호받는다는 사실을 표시한 콘텐츠의 전부 또는 상당한 부분을 복제ㆍ배포ㆍ방송 또는 전송함으로써 콘텐츠제작자의 영업에 관한 이익을 침해하여서는 아니 된다. 다만, 콘텐츠를 최초로 제작한 날부터 5년이 지났을 때에는 그러하지 아니하다.

② 누구든지 정당한 권한 없이 콘텐츠제작자나 그로부터 허락을 받은 자가 제1항 본문의 침해행위를 효과적으로 방지하기 위하여 콘텐츠에 적용한 기술적보호조치를 회피ㆍ제거 또는 변경(이하 "무력화"라 한다)하는 것을 주된 목적으로 하는 기술ㆍ서비스ㆍ장치 또는 그 주요 부품을 제공ㆍ수입ㆍ제조ㆍ양도ㆍ대여 또는 전송하거나 이를 양도ㆍ대여하기 위하여 전시하는 행위를 하여서는 아니 된다. 다만, 기술적보호조치의 연구ㆍ개발을 위하여 기술적보호조치를 무력화하는 장치 또는 부품을 제조하는 경우에는 그러하지 아니하다.

③ 콘텐츠제작자가 제1항의 표시사항을 거짓으로 표시하거나 변경하여 복제ㆍ배포ㆍ방송 또는 전송한 경우에는 처음부터 표시가 없었던 것으로 본다.
