통상환경변화 대응 및 지원 등에 관한 법률 제20조(출입ㆍ검사 등)

① 산업통상부장관은 통상변화대응계획 또는 통상피해대응계획의 이행상황을 확인하기 위하여 필요하면 소속 공무원으로 하여금 통상변화대응지원기업 또는 통상피해지원기업의 사무소, 영업소, 사업장, 공장, 창고, 그 밖에 필요한 장소에 출입하여 통상변화대응에 관한 서류, 장부, 그 밖의 물건을 검사하게 하거나 관계인에게 질문을 하게 할 수 있다. <개정 2008.2.29, 2013.3.23, 2021.10.19, 2024.2.20, 2025.10.1>

② 고용노동부장관은 필요한 경우에는 소속 공무원으로 하여금 제13조제2항(제15조제3항에 따라 준용되는 경우를 포함한다)에 따라 지원을 받은 자의 사무소에 출입하여 지원과 관련된 서류, 장부, 그 밖의 물건을 검사하게 하거나 관계인에게 질문을 하게 할 수 있다. <개정 2010.6.4, 2021.10.19>

③ 제1항이나 제2항에 따라 출입ㆍ검사 등을 할 때에는 검사일 7일 전까지 검사일시ㆍ검사이유 및 검사내용 등을 포함한 검사계획서를 검사대상자에게 알려야 한다. 다만, 사전통지를 할 경우 그 목적을 달성할 수 없거나 긴급한 사정이 있다고 인정되는 경우에는 그러하지 아니하다.

④ 제1항에 따라 출입ㆍ검사 또는 질문을 하는 공무원은 관계인에게 자신의 권한을 나타내는 증표를 내보이고 성명과 출입ㆍ검사ㆍ질문의 시간 및 목적 등이 적힌 문서를 내주어야 한다.
