특수임무수행자 보상에 관한 법률 시행령 제11조의2(근무기간의 계산)

① 법 제6조제1항에 따른 보상금의 지급기준이 되는 특수임무수행자의 근무기간은 특수임무와 관련한 최초의 교육훈련이 시작된 날이 속하는 달부터 계약 만료, 해고, 전역, 사망, 행방불명, 형사처벌 또는 보직 조정 등으로 더는 특수임무를 수행하지 아니하게 되거나 이와 관련한 교육훈련을 받지 아니하게 된 날(이하 "특수임무종결일"이라 한다)이 속하는 달까지의 월수(月數)로 한다.

② 제1항에 따른 근무기간을 계산할 때 특수임무를 수행한 장교와 특수임무수행을 위하여 군 첩보부대에 보직된 부사관 및 군무원의 경우에는 군 첩보부대에 보직된 날이 속하는 달부터 그 보직이 종료되는 날이 속하는 달까지의 월수로 한다.

③ 제1항에도 불구하고 특수임무수행자(제2항에 따른 특수임무수행자는 제외한다)가 본인의 책임없는 사유로 특수임무가 종결되어 근무기간이 특수임무종결일 당시 현역병의 복무기간 또는 계약기간에 미치지 못하는 경우에는 당시 현역병의 복무기간 또는 계약기간을 특수임무수행자의 근무기간으로 본다.

④ 특수임무의 종류, 복무 형태 및 특수임무 수행환경에 비추어 필요하다고 인정되는 경우에는 제1항부터 제3항까지의 규정에 따른 근무기간의 2분의 1을 초과하지 아니하는 범위에서 특수임무수행자의 근무기간을 가감할 수 있다.
