특허법 시행규칙 제106조의6(우선권서류의 제출)

①조약 제2조(vi)의 규정에 의한 국내출원 또는 국제출원을 기초로 하여 우선권을 주장하고자 하는 자는 우선일부터 1년 4월이내에 별지 제48호서식의 우선권서류 송달신청서에 그 국내출원 또는 국제출원을 수리한 관청이 인정하는 당해국내출원 또는 국제출원의 등본(이하 "우선권서류"라 한다)을 첨부하여 지식재산처장에게 제출할 수 있다. <개정 2001.6.30, 2006.12.29, 2025.10.1>

②대한민국에 제출한 특허출원ㆍ실용신안등록출원 또는 국제출원을 기초로 하여 우선권을 주장하려는 자는 국제출원의 출원서, 보정서 또는 추가 신청서에 우선권서류의 송달신청의 취지를 적거나 우선일부터 1년 4개월 이내에 별지 제48호서식의 우선권서류 송달신청서를 지식재산처장에게 제출하여 우선권서류를 국제사무국에 송달할 것을 지식재산처장에게 요청할 수 있다. <개정 2001.6.30, 2005.2.11, 2006.12.29, 2008.12.31, 2018.5.29, 2025.10.1>
